Constitution of Rastriya Prajatantra Party Nepal


Nepalese People have through the historical peoples’ movement of 1990 established a constitutional monarchy, multi party democracy based on parliamentary system, restored human rights and vested sovereignty with the people.
In the order to secure and uphold these inviolable, irrepressible and unassailable rights achieved by the people, it becomes an obvious fact that only if the political parties committed to democracy can move ahead vigorously will there be a security of the rights and it’s composition as granted and guaranteed by the constitution, provided the following conditions are met; Ensuring basic human rights of every citizen on the basis of equality of freedom, establishing a unity of brotherhood among the Nepalese, strengthening and expanding the foundation of nationalism, maintaining national sovereignty, territorial integrity and independence, enhancing the prestige of Nepal in the international sphere and concretizing the concept of the rule of law through the provision of a free and competent judicial system.


  1. Name and preliminary:
        A.This constitution has been named ‘The Constitution of Rastriya Prajantantra Party Nepal 2048′.
        B.The name of the party will be RPPN in short and Rastriya Prajatantra Party Nepal in full form.
        C.This constitution will come into force with immediate effect.
  2.  Definition:
     Unless otherwise stated in its subject or context:

        A. The Constitution will mean the constitution of RPPN 2048.
        B.  Legislation will mean the rules and regulation framed by the party’s central executive committee.
        C.  Committee will refer to all the executive committees formed under the party constitution.
        D.  The member it will also denote members holding office and position.
        E.  Municipality will refer to both metropolis and sub-metropolis
 3. Office:
    The central party office will be kept in Kathmandu, and other district level offices will remain in district headquarters. And other level offices will be placed as determined by the related executive committee.
 4. Symbol, Flag and Stamp:
       A. Cow will be the election symbol of the party.
       B.The party flag will bear a farmer’s plough within an industrial wheel or circle known as chakra in the center with sky blue border followed by white, green and yellow colors in the background.
       C.The circular stamp will bear party name on the top and under it will be printed the name of concerned level executive committee and its office with place and year.

Chapter-2 (Objectives and Membership)

 1.  Objectives and Membership:
    While remaining committed to constitutional monarchy, people’s sovereignty, parliamentary system and multiparty democracy, RPPN  will have the following objectives:
    To establish democratic society with human rights through an all round and balanced development of all sectors, regions, caste, nationalities and classes and by rendering the kingdom of Nepal into developed, strong and prosperous nation.
    To protect and promote national interest and welfare of Nepal while expanding and consolidating the basis of Nationalism within a democratic framework.
    To make the national economy free and self reliant through liberal, open and competitive economy and also to provide support for the economic and social development of the poor and backward as well as to promote state participation and leadership in areas with high social returns.
    It will also be the objective of RPP: To conduct and pursue a foreign policy based on the tenets of world peace, international law, and charter of UN non-alignment and the principles of panchsheel.
 2. Membership:
    Party membership will be as follows:
        For ordinary membership the following criteria are specified.

          i. Nepali Citizen
          ii. Above 16 years of age.
          iii. Committed to party principle.
          iv. Mentally healthy.
            With the above qualifications a person will be awarded an ordinary party membership with the payments of Rs.10/- for the period of 4 years. And this membership will have to be renewed before village and municipality council elections.
      B. Active Membership:
        For active membership the following criteria are to be met:

          i. A person engaging at least for 30 hours a month in the party activities such as party development, extension and distribution of membership and party organization can apply for active membership with the payment of Rs. 50.
          ii.On the application, the local party committee will work out its’ judgments or opinion and send it to the district executive committee. And according to the recommendation of the local committee the concerned department will award active membership on the payment of Rs. 50/-
          iii.The certificate of Active membership will be handed by the party central working committee. But this committee can authorize the district committee or any official or even an active member to do so.
          iv.In special cases, the party central Chairman can award active membership on the payment of Rs. 50/. But the name of the member will have to be sent to the related district committee. Every active member profile will be sent to the related district. Every active member will have to renew the membership according to the article 6 (a) 15 of the constitution.
          v.The active member will have to submit the work details to the concerned department every three months. This kind of presentation to the senior level is to be regularly sent by every levels of organization.
          vi.Active membership is a compulsory requirement for the candidates seeking to run elections for the post of Village/Municipal chairman and above.
      C. Member’s record Profile:
         The details such as name surname and address of the member will be kept and maintained in the offices of related village, municipality, constituency region and districts. The district executive committee will have to send one copy of member profile to the party central office and the central office will also have to keep profile of the active members throughout the kingdom.
       D. End of membership:
        There will be the end of membership in the following conditions.

           i.Death of the member
           ii.In resignation
           iii.Failure to renew membership
           iv.For taking other party membership.
           v.Expulsion from party on disciplinary action.

Chapter-3 (Organizational Structure)

  1. Organizational Level :
       Based on the village committees, parliamentary constituency regions and administrative divisions, the party organizational structure will be as follows:

        A.Ward level:
            Ward Council
            Ward executive committee
        B.Village or Municipality level:
            Village Council
            Village executive committee
            Municipality Council
            Municipality Executive Committee
       C.Regional Level:
            Regional Council
            Regional executive committee
        D.District Level:
            District Council
            District executive committee
        E.Village or Municipality level:
            Central Convention
            Central Council
            Central executive committee
            Other Committees
   2.Ward Council
        A.In every village development committee, ward having at least 15 general member of the party will form one village ward council and in a municipality ward committee of at least 50 members one municipality ward council will be formed.
        B.Office bearer & members of the ward executive committee will also be the members of their respective councils.
   3.Ward Executive Committee:
        A. A village ward executive committee will constitute 7 members of comprising of a Chairman a secretary.
        B.In a village ward executive committee, three members including the Chairman will be elected from ward committee and other 3 members will be selected by the Chairman from ward council. And the Chairman will nominate one of the members as a secretary.
        C.A municipality ward executive committee will constitute 9 people consisting of a Chairman, via chairman, a secretary, a treasurer, an assistant secretary and 4 members.
        D. Municipality ward council will elect the Chairman and four members of the municipal executive committee and, the Chairman will nominate four members from ward council. And the choice of the office bearer will be decided by the Chairman from any of the members.
    4.Village/Municipal Council:
        A.In a village development committee a village council having the representation of ward executive committee members and in a municipality a municipality council having the representation of municipality, ward executive members will be formed.
        B.Village council will elect a village executive committee and the municipal council will elect a municipal executive committee.
        C.The Chairman of party organization committees in village and municipality level will be observers at the village and municipality council meeting.
    5.Village/municipal executive Committee:
        A. Village executive committee will consist of 15 persons comprising of a Chairman, vice Chairman, secretary, assistant secretary, treasure and members.
        B.In a municipal executive committee there will be 19 to 35 persons depending on the number of ward. This formation will be of one Chairman, vice Chairman, secretary, treasurer, assistant secretary and members.
        C.50% of the executive committee members and a chairman will be elected by the related council but the rest 50% will be nominated by the Chairman out of the other council members.

The Chairman will designate the office holders from among the related executive committee members.

   1. Regional Council:
    In a regional council the following will be the members;

       A. All official and members of regional executive committee.
       B. All the Chairmen of village executive committees and 3 representative members selected by the village executive committees out of its members.
       C.All official and members of municipal executive committee within the region
       D. All the municipal ward executive committee Chairman.
    2.Regional Executive Committee :
    The organization of regional executive committee will be as follows:

       A.This committee will comprise of 15 members consisting of one Chairman, vice Chairman, secretary, treasurer, assistant secretary and members.
       B.50 % of members including the Chairman will come from regional council through election. And the rest 50% will be nominated and designated by the Chairman. The chairman will nominate post bearers from among the members of regional executive committee.
       C.Regional representative to the central executive committee will be invited to the regional executive committee meeting.
       D.Elected RPPN  parliament members of the regions will be members of the related regional executive committee
    3.District Council:
       A. In a district council the following will be the members:
           i. All the designated and non-designated members of district executive committee.
           ii.All the designated and non-designated members of regional executive committee.
           iii. Party parliament members and district representatives to central executive committee.
           iv.Chairman of village and municipal executive committees.
           v. Representative member making one forth of the total ward numbers selected by the municipality executive committee.
      B.In the context of a district having only one electoral constituency region, the following will be the district council members.
           i. Designated and non-designated members of district executive committees.
           ii. Party parliament members of the related districts and district representatives to the central party executive committee.
           iii. All the Chairmen of village executive committee inside the district and three representative members select from among the village executive committee.
           iv. All designated and non-designated members of the party municipal executive committee of the district.
           v.All the Chairmen of municipal executive ward committees of the district.
    4. District Executive Committee :
    The organization of the district executive committee will be as follows;

       A.This committee will accommodate 15 to 27 persons consisting of a Chairman, vice Chairman, secretary, treasurer, assistant secretary and members. In specifying the committee members there will be 15 in a district of one constituency and each 2 more from each additional constituency.
       B.Including a Chairman, 50 % members from the district executive committee will be elected by the district council and the rest 50 % will be nominated and designated by the Chairman.
       C.Elected parliament members of that district will be ex-officio members of this committee.
       D.Regional Executive committee Chairman will be an ex-officio member.
       E.All the Chairmen of the district level class organizations will remain as the observers in this body but they won’t have the right to vote nor to run for election.
       F.The relevant district representative to the party central committee will be as invited guests.
    5.Function and authority of local councils:
    From ward to district level, party organization council, will have following duties and rights.

        A.To supervise, evaluate, inspect and guide activities of executive committees.
        B.To discuss, verify and approve the report sent by executive committees.
        C.To conduct election of the concerned/related executive committees.
        D.To discuss and finalize the account report sent by the executive committee.
    6.Duties and authority of local Executive Committees:
    The following will be the duties and authority of the executive committee from ward to district level.

        A.To follow party policies, principles, programs and directions.
        B.To assist people in resolving their day to day problems.
        C.To lead and organize people welfare activities.
        D.To conduct program, against partiality, injustice and suppression.
        E.To Prepare disciplined and dedicated party activists.
        F.To promote harmony, coordination, goodwill and cooperation between elected committee members and class and occupational organizations in their respective local levels.
        G.To remain ever active for contributing effectively in the consolidation of the party organization.
        H.To analyze the political, economic, social, educational, business, security as well as the various causes of peoples grievances.
        I.To conduct meetings conferences, seminars and trainings.
        J.To conduct membership drive continuously, renew membership and recommend for active membership.
        K.To maintain the records of party activists/cadres.
        L.To carryout works felt necessary by executive committees.
        M.To submit recommendation to the senior organization for the suspension and disciplinary action against those party members who work against party interest, bring division within the party and disrupt party unity, defy party decision, offer candidacy against official party nominees or propose and second for such rebel candidates and involve in anti-party activities.
        N.To form 3 member disciplinary committee in order to take action against undisciplined party activists/cadres.
        O.To formulate election committees under the directives of central election committee at different levels.
        P.As per the political and physical needs required for the political mobilization, the district executive committee can form a \”party area co-ordination committee\” with members at the moot in areas stipulated for the formation of District Development Committee.
   7.Duties and authority of local executive committee members:
           i. To preside over the meeting of associate council and executive committees
            ii.To provide necessary instruction to the members of executive committee and conduct everyday programs of the party.
            iii.To implement or give instruction of implementation upon and policies and programs passed by related councils.
            iv.To implement programs as instructed by the senior level organizations.
            v.To lead, implement, monitor and take responsibilities over the duties of the local executive committee.
        B.Vice Chairman
            i.To carryout all the responsibilities of the Chairman in his absence.
            ii.To carry out other functions assigned by the party.
            i.To call the meeting of executive committee on the direction of the chairman.
            ii.To run daily party activities.
            iii.To implement the decisions passed on the executive committees.
            iv.To do accordingly as the Chairman directs from time to time.
            v.To present the report in the level wise council and executive committee meetings.
            vi.To maintain all party records.
            vii.To send report to the central office about party activities, meetings and decisions.
            i.To be responsible for mobilizing the entire fund.
            ii.To keep the account of all income and expenses.
            iii.To have a timely and periodic auditor’s reports to be brought before the councils and committees.
        E.Assistant Secretary
            i.To handle all the responsibilities of the secretary in his absence.
            ii.To perform other works as directed by the party.
    8.Central units of the party:
    Party central units will be as follows;

       A. Central committee convention
       B.Central board council
       C.Central Executive Committee
       D.Other Committees;
       E.Central Working Committee
       F.Parliamentary Group
       G.Parliamentary Committee
       H.Disciplinary Committee
        I.Judiciary Committee
   9.Central convention will be the highest party organization body, and following will be its members:
       A. All the official and non-official members of this central executive committee.
        B.All the members of party parliamentary committee.
        C.Party parliamentary members.
        D.Members of central committee.
        E.4 district representatives including one women selected by the district executive committee in district having more than one electoral constituency.
        F.1 regional representative selected by the regional executive committee from the districts having only one constituency. 4 representatives including 1 women selected from among the District Executive Committee.
        G.Chairmen of municipal executive committees.
        H.35 (at the most) nominated members by the central party chairman will remain as observers without voting rights. These nominees will be selected by the chairman based on their contribution to the party activities.
        I.Chairman of the party class organization, central committee will also be the observers and with no rights of voting and candidacy.
    10.Duties and authority of party central Convention:
        A.To elect a Chairman and members for central executive committee.
        B.To take decisions on party policy matters.
        C.To discuss upon political, economical and social reports submitted by the central executive committee and pass them.
        D.To provide programs for central executive committee.
        E.To review the entire party activities and provide necessary directions and guidelines.
        F.To amend the constitution.
        G.To discuss upon the reports of party general secretary and party treasurer and approve them.
   11.Central Council :
    The following will be the members of central council.

       A. Members of the central executive committee.
       B.Party parliamentary members.
       C.Chairman of party district and regional committees.
       D.Two representatives selected by members of the regional executive committees from among themselves and two members selected by district executive committee in the case of districts which have only one constituency region.
    12.Duties and authority of Central Council :
        A.Central council will discuss upon the prevalent political, economical and social and other current issues and clearly state party’s position on them.
        B.To analyze party activities and provide necessary directions to central executive committee.
        C.Central committee will not interfere in the constitutional amendment in between one general convention to the other but besides this, it will carry out the duties of the convention if necessary.
        D.In matters of national importance and interest, this body will take immediate decisions and execute them as necessary.
    13.Central Executive Committee:
    This committee will execute all the programs directed by the general convention and central council and will also remain answerable to central council and Central Convention.
    Formation of central executive committee will be as follows;

        A.There will be a Chairman, vice- Chairman, general secretary, one speaker and one assistant general secretary and members totaling 41 in numbers.
        B.Including 10 percent women members and a Chairman, 50% members will be elected while the rest 50% will be nominated and designated by the Chairman himself.
        C.It is mandatory to be a member of general convention to become the candidates for chairman and members in the election or nomination.
        D.Designated members of this committee can’t take turn for more than 2 times in office.
   14. Duties, functions and power of Central Executive Committee :
        Following will be the job, duties and power;

       A.To execute policies, programs and decisions passed by the central general convention and central council
       B.To design and develop different activities and execute them in order to meet party objectives.
       C.To supervise, evaluate, monitor and give necessary direction and consultations at various levels.
       D.To formulate and implement a code of conduct for party cadres.
       E.To maintain records of active party workers throughout the country.
       F.To explain the party constitution decisively.
       G.For the purpose of meeting the needs of the party at central level to form committees, departments and commissions and stipulate their purpose, place, duties and authority.
       H.To analyze and evaluate current national and international issues and seek their solutions.
       I.To bring out publication of party manifesto.
       J.To assign responsibilities to central committee party official, non-official members and dedicated party cadres.
       K.To evaluate the activities of class and occupational unions.
        L.To carryout disciplinary investigation of the district and above level officials and form a disciplinary committee for action recommendation.
        M.In the event of any party unit organization, the member or official is deemed or seen as being inactive or indulging in anti-constitutional activities and behaving irresponsibly and defying party directives and creating division within the party then such party units and workers will be served a notice of suspension and warning on the recommendation of the disciplinary committee. However if, even after such a notification reinstatement of discipline felt to be lacking the central executive committee can expel the member and dissolve the party organization in question at the recommendation of the central disciplinary committee.
        N.Until next election this committee can form an ad hoc committee in place of dissolved party organization.
        O.To increase and mobilize party fund.
        P.To perform necessary works for spreading party’s impacts and influence among the people and consolidating party organization.
        Q.To reshuffle party organizational units in times when constituencies are dismissed or changed or when VDC’s are incorporated into municipalities.
        R.To study and evaluate the reports received from party or organizational bodies and party supporting class unions and take necessary actions against them.
        S.To study and evaluate party position and prepare and submit report into the council or general convention at the time of general and local election.
        T.To extend and maintain friendly relation with national and international association and organizations and work for mutual benefits.
        U.To appoint an auditor and maintain a clear, regularized and transparent party financial management.
        V.All that is required for the consolidation of the party.

Chapter-4 (Duty, function and authority of Central Executive Committee officials)

        A.To provide an effective leadership in running the party as a strong and efficient organization by holding high the ideals, principles and prestige of the party.
        B.To chair party general convention, central council and central committee meetings; to assign responsibilities, to provide directives through various levels of the party committees.
        C.To maintain party discipline and direct the central executive committee whenever necessary for action.
   2.Vice Chairman
        A.To carryout the responsibilities of the chairman in his absence.
        B.To carryout any other functions as required by the party.
    3.General Secretary
        A.To conduct day to day function of the party, call party meetings as instructed by party chairman and to carryout the functions as stipulated by the chairman from the time to time.
        B.It will be the responsibility of the party general secretary to implement party decisions.
        C.To submit party report in the general convention, central council and committee meetings.
        D.It will be the responsibility of the party general secretary to ensure day to day running of the party central office.
        E.It is the responsibility of general secretary to have all the party documents and records maintained.
        A.The responsibility of all the party funds lies with the treasure.
        B.To have income and expenses audited by an auditor and submit this report to the party convention, council and committee as per the instruction of the chairman.
        C.Have the entire executive and other committees maintain their financial accounts audited and updated.
        D.To collect contribution from party members as fixed by the central committee from party members who are elected, nominated or appointed with party approval.
   5. Party Spokesperson
       It is the function of the party spokesperson to make public, the official view of the party on various current issues and policies, through the media.
    6.Assistant general secretary:
        A.To carryout all the responsibilities of general secretary in his absence.
        B.To carryout other directions of general secretary.
        C.To look after and control party central office management.
        D.To do party appointed tasks.
    7.Parliamentary Board:
        A.Either the party chairman or one of the central members appointed by the chairman will chair this board. This board will constitute the following formation
             i.Party chairman or one of the central members appointed by the chairman
            ii.Parliamentary leader Member
            iii.Five nominated members of the central council by the chairman Members
            iv.One of the committee members appointed by the Chairman Member-Sec.
            v.In case when one person is both the party chairman and parliamentary leader, then 6 instead of 5 will be nominated members.
        B.Functions, Duties and authority of this board will be as follows:
            i.To give necessary directions to the party members elected in the parliament and coordinate with the parliament in regards to party activities.
            ii.To select candidates for general election on the recommendation of regional executive committee and forward the report to central executive committee for approval.
            iii.To select candidates for upper house from the party and forward to central executive committee for approval.
            iv.In recommendation with district executive committee, Select the candidates for district Chairman, vice-Chairman in local elections.
            v.To make a working constitution and send it to the central executive committee for approval and conduct activities according to it once it gets approved.
    8.Parliamentary party:
     Consisting of the elected parliament members and upper house members, a parliamentary committee will be formed. One of the parliament members will be elected as a parliamentary leader by the committee members. This will form a working constitution and follow it after having it approved by the central executive committee.
    9. Central Working Committee:
      In the chairmanship of party chairman 7 member central working committee will be formed. There will be a general secretary and 5 central executive committee members nominated from among the committee members.
     The following will be its job and duties;

        A. To carryout the immediate works of central executive committee during the intervening period of the two meeting.
        B.To follow and implement central committee decisions and monitor the implementation.
        C.To do all the tasks passed on to by the central committee.
        D.To table all kinds of works such as job accomplishments, decisions and important issues, into the central executive committee meeting that follow.
    10.Disciplinary Committee:
        A.Under the convenorship of a central committee member, the central executive committee will form a five members disciplinary committee. Rest of the other members will be selected out of general convention representation.
        B.This committee will monitor disciplinary code of action of all members and will prepare the report for action. But except for the district executive committee officials and members as regards the necessary investigation on the indiscipline and code of conduct of local level cadres this committee can delegate its power to district executive committee, district disciplinary committee or any person.
   11.Judiciary Committee:
    Including a central member appointed by the central executive committee, a 3 member Judiciary committee will be formed. The rest two members will be selected out of the general convention representatives. The job, duties and authority of this committee will be as following.

        A.To present written opinion to the central executive committee when asked on the difficult question regarding the interpretation of the party constitution.
        B.To submit its opinion on the question of constitutional and legal matters related to the party, to the central committee.
        C.To produce written opinion on the subject of discipline and election to the central committee or any other central level commissions and sub committees if needed.
        D.To do other judicial works directed by the central committee.
   12. Advisor :
        A.Different level executive committees can nominate their advisors for the sake of convenience in party functioning but not beyond and above the number in related executive committee members.
        B.These Advisors can be invited in need of executive and related council meetings.
    13.Central Secretariat :
      There will be a central secretarial under the convenorship of the general secretary to effectively carry out the functions, decisions, programs and policies of the central executive committee.
      The following will be it’s functions and responsibility.

        A.To prepare party policies, programs and action plan at the central level.
        B.To develop strategies for the effective implementation of the programs to be conducted by the central committee and party organization under it.
        C.To coordinate and conduct the functions of various department of central committee effectively.
        D.If party views on contemporary issues are to be made public, this secretariat will do so.
        E.To establish harmony among the party organizations in co-ordination with central committee.
        F.To carryout the responsibilities assigned by the central committee and central council.
   14. Meeting Management:
        A.Central executive committee meeting will be held at least once in three months but other level executive meetings will be held once in a month.
        B.All level council meetings will be held at least once in a year but it will not meet in the year of general convention.
        C.General convention will be held once in four years.
        D.Every level executive committees and councils will have to send the meeting reports to their seniors’ levels, i.e. decisions and the information of the programmers held in the committees.
        E.The general secretary or secretary will have to call the meeting with the order of the Chairman in condition of written demand made by one third members of councils, committees or central convention.
        F.Every level of committee, council or convention meeting will be chaired by the relevant chairman.
        G.To carryout the responsibilities assigned by the central committee and central council.
    15.Post Expiry Vacancy and Fulfillment:
        A.If any member is promoted to upper level by election or nomination, the current post will fall vacant but if the person elected to central council member or convention representative from a regional level is elected or nominated to district executive committee, the current post will remain intact.
        B.Officials at any level who remain absent in three consecutive meeting the concerned executive committee can decide to terminate the post of such a member. But such a member will not be deprived the opportunity of clarification.
        C.If any elected post remains vacant, it will be fulfilled by the decisions of concerned level executive committee for the remaining period.
    16.Election Committee and Election Procedure:
        A.Election committee will be formed in order to organize party systematically at different levels.
        B.The duties, functions and power of election committee will be as specified by the central executive committee.
        C.If more than 50 % lower level committee units are formed in election, then higher level committee units can be formed. But this won’t be implemented in the village executive committee elections. Election procedure will be as specified by the central election committee.
        D.Election at all levels will be done through the related councils, but the election of central executive committee will be made through the central convention.
        A.As regards nomination priority will be given to backwards aborigines, nationalities.
        B.Elected through district development act, municipality act and village development committee act, party representatives, district Chairman, district vice Chairman, municipality Mayor or vice chairman, V.D.C. chairman and vice chairman will be the members of relevant level executive committee.
        C.At all levels committee member election only the party parliamentary members and elected or nominated representatives of council or convention can participate.
        D.5% of the women representation is compulsory at all level of executive committee.
        E.The decisions of every councils, conventions and executive committees will have to be verified by the chairman of the respective level.
    There will be separate funds of the party at different levels. The following will be the funds. Types of fund

        C.Proceeds and revenues from organizing activities
        D.Donations from organization, association and individuals without negatively affecting party objectives.
            i.Local fund
            ii.The collected fund should be deposited in the bank account but this system in not compulsory in village and regional level. The fund will be mobilized only by the treasure and executive committee appointed member or official.
            iii.Party account will be maintained according to the current accounting system and the account will be audited and the report will be presented in the related executive committee.
            iv.Party property, either stationary or mobile will be accounted in the manner of a cash account system.
    19.Affiliated Organizations (Class and Occupational Organization) :
        A.Party will consider them as sister organizations, which support  RPPN  principles.
        B.There will be only one authorized organization in a class and occupational sector. Such authorized organizations will have to obey party instructions and follow its principles.
        C.Party related class, occupational or sister organizations will be defined by the central executive committee. And their legitimacy also will be certified by this committee.
        D.The organizations that work against party spirit, disobey party central committee instructions and are inactive can be dissolved by the party central executive committee and can be replaced with ad hoc committees.
        E.Such an ad hoc committee will have to have its conventions and form an executive committee.
    20.Capability of framing rules and regulations:
         The central executive committee can formulate, implement necessary rules within the periphery of the constitution.
   21.Resolve impediments and Override obstructions:
        With regard to the implementation of this constitution and any obstruction arising out of such implementation, the central executive committee can take decisions to override such obstructions.
   22.Meeting Forum:
        Central convention, central council and other level council meeting quorum will be one third of the total members. But the forum of executive committee meeting will be 51% of the total members.
   23.Delegation of power:
       Constitutionally mentioned power can be delegated to other officials of associate committees and sub committees by the authorized officials.
   24.Framing and amendment of the constitution:
        Central convention can amend and implement the constitution having it passed by the simple majority.
         According to the constitution all level committee and council members will be elected or nominated for the period of four years. In special circumstances like the failure of party conventions the central executive committee can extend its period for one additional year and this is applicable to the junior levels as well.
    26.Tabling no confidence motions:
        A.A no-confidence motion can be brought against all members and officials of all levels of executive committees up to the district level if found to be failing in discharge of duties consistent with the responsibilities and damaging the party interest and welfare. The vote of no-confidence can be registered with the relevant executive committee by one-third of the total member of the councils. The vote of no-confidence thus registered will be presented before a higher level committee which will set a date for the concerned council meeting. The person under the motion will be relieved of the post if the council meeting decides in favor of the motion by two-third majority.
        B.A no-confidence motion can be registered at the office of the central committee if the proposal is signed by one-third member of the central convention. After the registration of such proposal would be discussed at central committee after 15 days and the decision to put the matter before central convention will also be made for which a date to call for special session of the convention will be set. The concerned member would be relieved of his post if the motion is adopted in favor by two-third majority of the central convention.
        C.The no-confidence motion cannot be tabled (tabulated) until the completion of 1 year after the election and if the motion fails if cannot be revived until the completion of next 1 year.
        D.If the vote of no confidence is against the chairman himself the meeting will be chaired by one of the central committee appointed members or official. But in case of other committees the absence of chairman will be fulfilled by the vice chairman only.
    27.Remedial Measure:
        The members of central convention, central council or junior level executive committees and councils formed before the implementation of amended constitution will be considered as formed according to this constitution.
